The government delegation in Milan (northern Italy) has informed the city’s mayor, Giuseppe Sala, that children born abroad must stop registering as children of same-sex couples.
“This, in my opinion, is a clear step backwards from a political and social point of view, and I put myself in the shoes of those parents in Milan who thought they could count on this possibility,” Sala said today after receiving the notification.
The notice reached him from the Government delegation, which in turn had received the order from the Ministry of the Interior, in based on a 2004 law on medically assisted procreationthat It is allowed only to couples formed by people of different sexexplained the mayor to the media.
Reference was also made to the latest ruling of the Supreme Court which ruled that Children born abroad by surrogacy “must be recognized in Italy as children of both parents by adoption in particular cases, which requires the approval of a judge, and not by transcription in the civil registry.”
The circular from the government delegation explains that only “the parent who has a biological link with the child” can be mentioned on the birth certificate and the “transcription of birth certificates issued abroad” is not allowed, according to the media.
“It is an act that logically has to do with the administrative apparatus of the municipality and, given the position adopted by the government delegation, I cannot expose a municipal official to personal risks of a judicial nature,” Sala said today in his podcast “Buongiorno Milano” (Good morning Milan).
In the mayor’s opinion, “it should be the legislator who allows by law, as occurs in other European countries such as Spain and Denmark, the registration of the child of a same-sex couple.”
Sala met this Monday with some representatives of the affected families to explain what had happened and ensure that this It will be his “political battle” with the Government.
In July 2022, the mayor of Milan began to authorize the registration of the children of homosexual couples, considering that there was a legal vacuum and there are nearly 300 families that have been able to register their children as their own, and not just adopted, in the civil registry.
“Is a painful and unfair decision. The mayor of Milan had to give in to pressure from the government of (the far-right Prime Minister Giorgia) Meloni. He has informed us that he will block the transcriptions of foreign birth certificates of children with two fathers and the formation of Italian birth certificates with two mothers, as has been guaranteed in recent years”, lamented the president of the Rainbow Families association, Alessia Crocini.
I reject homosexual unions
The spokesman in the Italian Senate of the government party Brothers of Italy, Lucio Malan, received numerous criticisms last November after rejecting homosexual marriage on the basis of the Bible and underlining that he defines it as an “abomination”.
Malan spoke on the radio program “Un giorno da pecora” to comment on current political events and ended up insisting on his rejection of the bill against sexual discrimination promoted by the representative of the Democratic Party (PD), Alessandro Zan.
The announcer, in a humorous tone, pointed out that he is a member of the Waldensian Evangelical Church, which blesses homosexual unions in Italy, to which the senator replied, also laughing: “But we do not have the duty of obedience, the Waldensian Church is founded on the Bible, not on the hierarchy”.
Asked if the scriptures reject same-sex couples, Malan argued that “there are worse things.”
“Not about marriages because obviously nobody thought that there could be gay marriages two thousand years ago (…) But it is written that homosexuality is an abomination. Both in the Old and in the New Testament,” she maintained.
His words were highly criticized by LGBT activists and the center-left opposition, especially since Malan represents the party that has ruled the country for a month and whose leader is the Italian Prime Minister, Giorgia Meloni.
